Maybe it fails with 4.0.4, but it does work with 4.1.9. The bug, if it exists,
will not be fixed in 4.0.x.

The response sent by Tomcat 4.1.x is valid and my IE 6 (on Win XP), as well as
Moz, is happy about it.
