Erik, the behaviour you are seeing is the intended one. When you create an 
instance of Xerces.DOMDocument, it already has an empty document attached, 
that you can start manipulating. When you issue the parse() method call, that 
document will be replaced with the result of the parsing operation; but, if 
the parsing fails, you will get the error back while the COM object will 
retain the previous (valid) DOM.
