It would block the podling from graduating.  There is nothing stopping you from releasing
as is, with the understanding that your incubation disclaimer is present in the release. 
Newly developed code (source files) should wear the ASF header statement, existing code being
modified should retain the existing one until an SGA is processed.

about whether or not it is required to have an SGA submitted by Twitter for the project. Some
thought that getting developer ICLAs would be sufficient. Twitter has also required contributors
of the project to submit CLAs to Twitter. No consensus was reached on that thread so I'm posing
that question here to see what the required course of action is.
