1. I agree, there is no perfect solution here.

2. I agree that using BSD licensed code isn't against Apache policy.  However, you must agree
that the expectation is that projects are producing Apache licensed code.  We can't leave
non-Apache headers on what is supposed to be Apache licensed modifications (and as a result,
raises a bigger question to me about how we handle modifications in general)

3. I really think before we can worry about what gets communicated, we need to decide what
is the real license on these files.  

4. I'm not challenging the decision made previously.  The prior decision was explicitly under
the guise of "no modifications" however we're now in a situation of modifying those files.
 So really the question is the same as #2 in my list.
