Jim Jagielski commented on LEGAL-289:

I doubt if I said that OSI was not the last word. The fact is that a license is not an Open
Source license unless and until it is sectioned as such by OSI. If the FSF has approved ACE
as a Free Software License, then we can use that.

Whatever license that are already on our catA list that may not be OSI/FSF approved have been
there for awhile; as such, even though we may change our determination of them as catA (eg:
JSON), we do so when there is or has been concern or reaction from our downstream users. I
believe in making consumption and usage of ASF projects as easy and straightforward as possible,
and a dependency on a non OSI/FSF approved license do NOT do that. We, the ASF, are NOT the
ones who determine what licenses are or are not "Open Source", i.e.: OSD compliant.

This is my decision as VP Legal Affairs. You are free to call for my resignation and ask the
board to appoint Henri who has a more lackadaisical attitude regarding the ASF and licenses.
If I could close this issue, I would.

> The Apache Geode project would like to include ACE as a bundled dependency in a binary
convenience artifact. Can you review the ACE license at http://www.cs.wustl.edu/~schmidt/ACE-copying.html?
It looks somewhat BSD-ish to me.
> Should the referenced license be added to the list of approved licenses?
