I made this change:

directly to the ASF for which the submitter is not the copyright owner or owner's agent. </li>

It speaks to your first item, while I think the second item (NOTICE file) should now extend
from that 'clearer' 3p definition.

Feel free to reopen if you think that needs more clarification though - not saying my text
is brilliant :)
