Marvin Humphrey commented on LEGAL-268:
---------------------------------------

I question whether this license conflicts with section 5 of the Open Source Definition? From
the annotations at https://opensource.org/osd-annotated ...

{quote}
Some countries, including the United States, have export restrictions for certain types of
software. An OSD-conformant license may warn licensees of applicable restrictions and remind
them that they are obliged to obey the law; however, it may not incorporate such restrictions
itself.

The question here is whether the relevant passage in the Aparapi license is advisory (which
is OK) or binding (which is discriminatory). IANAL, but the phrases "you shall adhere", "you
hereby certify", and "you will not" seem binding.

> Apache Hama and HORN (incubating) projects, considering to use of Aparapi, a Java bytecode
to OpenCL conversion tool developed by AMD for support SIMD and GPUs. That project is licensed
using BSD 3 with additional clauses as shown in the LICENSE file [1].

> The question is 1) can we include aparapi.jar and native libaparapi_x86_64.so binary
files in Apache projects, and distribute it under Apache 2.0?
