So would that also imply that as long as the dev mailing list is watching (in GitHub terms)
the project, and receiving a copy of all GitHub communication, then that means the issue tracker
may be used?

Alternatively, an issue mirror could be setup. I've most of the relevant code in github.com/amznlabs/oss-dashboard.

Lastly - ghtorrent's existence makes it hard to repudiate at a future date, so a simpler (higher
bandwidth) approach could be to get a copy of their data on a regular periodicity.

This was raised on a new project that we're beginning to incubate (Airflow). I asked INFRA,
and they suggested that I ask LEGAL as well as the board.
