I do no believe that there is any issue for eBay to continue to own this patent. The patent license granted as a result of eBay's contribution is sufficient. The patent does not need to be transferred to the ASF or anything. Neither does the existence of this patent cause any problems for the Kylin project. The terms of the ALv2 (specifically section 3) mean that this patent does not represent any risk to the users of Kylin or anyone taking the Kylin source and creating their own product from it. (Unless they decide to instigate patent litigation over Kylin in which case the patent license termination part of ALv2 section 3 kicks in.) You might want to add a PATENTS.txt file alongside NOTICE.txt and LICENSE.txt to let people know that this patent exists and to draw their attention to the associated patent license as per ALv2 section 3.
