You could ask W3C to license the test data under an open source license to make the situation
quite clear, either by extracting and publishing it separately or modifying the document's
license status.

As a test suite, it would normally be [dual licenced|http://www.w3.org/Consortium/Legal/2008/04-testsuite-copyright.html]
under [W3C Test Suite license|http://www.w3.org/Consortium/Legal/2008/04-testsuite-license.html|],
which does not permit modifications and [W3C 3-clause BSD License|http://www.w3.org/Consortium/Legal/2008/03-bsd-license.html].
