Lawrence Rosen commented on LEGAL-172:

@Sam,

> For a fourth time, I once again request that people who advocate for the need
> for additional copyright headers to be placed in a distribution identify specific
> things that the ASF can accomplish with these additions that it could not
> otherwise without. Things of value to the ASF itself.

I'll stray far from the current topic to describe an advantage that is more long-range and
intellectually interesting to me personally than the mere presence of a copyright notice.

About two years ago I contacted attorneys at the Library of Congress to see if there would
be any interest by them to maintain a historical repository of Apache software, like they
do for books, movies, music, (and Tweets!), so that future generations could understand how
FOSS developed and matured. We discussed interesting questions and court cases involving collective
works and compilations; the similarities and differences of other traditional forms of publishing;
the frequency and form of software updates that we do; the copyright law and LOC form requirements
for identifying authors and contributors; and the methods by which publications can be (semi-)automatically
delivered to the Congressional repositories for long-term storage.

I didn't proceed with any of this, of course, nor would I even attempt to do so without seeking
the support and cooperation of my fellow Apache members. But after my brief and unhappy tenure
on the Apache board of directors, I realized that there was no stomach to raise complex legal
questions now. And in any event, without a copyright notice nothing at all would ever be possible.

But I'm not trying to encourage a copyright notice in source headers just because I have some
long-range dreams that our valuable intellectual treasures will be preserved for posterity.
I'm recommending it because I believe we need to express our pride in ownership of our copyrights
like we now do for our trademarks.

But if you want me to set a dollar value to ASF for placing copyright notices on our files,
I can't do that.

/Larry

> The current ASF Source Header and Copyright Notice Policy does not include, and actively
discourages, any copyright notice in the header:
> http://www.apache.org/legal/src-headers.html
> Larry Rosen has requested that any source file that contains a license header also include
a copyright notice[1], and that his vote be counted[2]. This JIRA tracks these requests.
> The vote itself will take place on the legal-discuss mailing list, start shortly after
this month's board meeting on Wednesday, July 17th, and will continue through Sunday July
21st with the results published on Monday July 22nd. Only votes from members of the Legal
Affairs Committee PMC, as recorded in [3] will be considered binding. To pass, the vote will
need a minimum of three +1's and more +1's than -1's.
