The place to start is at the Apache Incubator, and any code will need a sponsor: http://incubator.apache.org/guides/index.html For legal aspects, I would recommend reviewing the 'IP Clearance" information available as a link from that page. Based on the information provided, I don't expect there will be any insurmountable issues.
