Er, "way around"? You're *telling* it to use an SSL connection:

  <user-data-constraint>
  <transport-guarantee>CONFIDENTIAL</transport-guarantee>
  </user-data-constraint>

If you don't want it to, don't do that. Pretty simple, really.  :-)
