I figured it out

it is to do with JSP 2.0 spec

if you put 

suppressSmap - false in web.xml 

like so... 

it works

    <servlet>
        <servlet-name>jsp</servlet-name>       
<servlet-class>org.apache.jasper.servlet.JspServlet</servlet-class>
        <init-param>
            <param-name>suppressSmap</param-name>
            <param-value>true</param-value>
        </init-param>
    </servlet>

I will do a how-to web page in the next couple of days
