Sure, there are workarounds, another is wrapping the logic:empty for the time
being inside a logic:present, as up to now the project isn't using JSTL.

But I think the author of the tag thougt as David initially, that
RequestUtils.lookup(pageContext, name, property, scope) would handle the special
case of a null property as this the normal behaviour for most struts tags. 
Maybe it would be a good idea to have a method in RequestUtils that has this
semantic.  It could even handle the case where name==null means use the form bean.
