What is the schema you are using for the ejb-jar.xml?  Here is an  
snippit from one of our working 2.1 test cases.

           xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance"
           xsi:schemaLocation="http://java.sun.com/xml/ns/j2ee
