Looks like this was dropped a commit or two ago:

r817650 SOLR-1447

Should prob just be reverted to what it was - not sure we need to try and cap it and it needs
the LogMergePolicy check. Though the >0 check makes a bit more sense to me than != -1.

        setMergeFactor(config.mergeFactor);
      }
