As a note, there are no tests where 

  overwritePending != overwriteCommitted

In SOLR-139, the XmlUpdateRequestHandler maps all varitions of allowDups, overwriteCommitted
and overwritePending  to a simpler 'overwrite' -- it throws an exception if overwritePending
!= overwriteCommitted.
