The bug is in TermQuery(Term, int docfreq)

if i change this to:
{noformat}
  public TermQuery(Term t, int docFreq) {
    term = t;
    // this.docFreq = docFreq;
    this.docFreq = -1;
  }
{noformat}

then the test passes
