Just a wild guess: try and remove the @ in the predicate inside jcr:contains:

/jcr:root/nen:content//element(*,nen:resource)[@dep:isarticle and
@dep:state = 'published' and @nen:type = '1' and
jcr:contains(jcr:content/jcr:data, 'fusce')]
