I don't know anything about the legal side, but it would seem to me to
be quite unacceptable to publish new releases with org.apache.*
namespace. That namespace belongs to the ASF, and users will expect that
anything published under that namespace has the approval of the ASF.

So if development of this code continues elsewhere, it simply *must*
change the package name - morally at least, and quite possibly the ASF
has a legal right to insist too.

It's unfortunate, as of course it will be an inconvenience to people
already using that code. But as it has never left the incubator, it has
by definition never made an official release with those packagenames.
