Or maybe it _is_ an unsafe reference, suexec -V reports:

 -D DOC_ROOT="/usr/apache/htdocs"
 -D GID_MIN=100
 -D HTTPD_USER="nobody"
 -D LOG_EXEC="/usr/apache/logs/suexec_log"
 -D SAFE_PATH="/usr/local/bin:/usr/bin:/bin"
 -D UID_MIN=100
 -D USERDIR_SUFFIX="public_html"

And /usr/apache/cgi-bin _isn't_ in /usr/apache/htdocs.
