Subject [users@httpd] cgi-shell

Some one ran cgi-shell on my web-server from within php (system(./cgi-shell-start))
(http://binaervarianz.de/projekte/programmieren/cgi-shell/)

now, before the cgi-shell telnet server has died, 
if i restart my apache, the cgi-shell takes up port 80 and 443
is this a bug in apache or in cgi-shell?
