Start stop with kill ??????
/etc/rc.d/init.d/httpd stop
/etc/rc.d/init.d/httpd start
or
/etc/rc.d/init.d/httpd restart

That's odd.  But you said that when you kill the root-owned process
directly it does work?  What exactly happens?  You are left with a single
root-owned process?
