Subject mod_mime_magic strange behavior

Has anyone seen this error:
(13)Permission denied: mod_mime_magic: can't read 
`/usr/home/user/public_html/blah.cgi

The file 'blah.cgi' works through a browser, but mod_mime_magic is 
complaining about it not being readable since upgrading to latest apache 
1.3.26. The file is chmod 700 - it runs through suexec, and executes 
fine. Other previously working scripts are doing the same thing.

I've cleaned up the error messages in error_log by adding
application/x-httpd-cgi         pl cgi
to mime.types as a workaround, but I'd like a better explanation of what 
is going wrong.
Ideas?
