Is much simpler (I was sa bit stupid): 

static int xmlns_filter_init_test(ap_filter_t *f)
{
  ap_update_mtime(f->r, apr_time_make(1141284490, 0));
  ap_set_last_modified(f->r);

  return OK;
}

does it including 304.
