Oooops... I spoke too soon.  Quoting the FastCGI LICENSE.TERMS:

  Open Market shall retain all right, title and interest in and to the
  Software and Documentation, including without limitation all patent,
  copyright, trade secret and other proprietary rights.

Mark, this particular paragraph seems to be really discordant with
your intentions as you describe them --- if you're trying to establish
FastCGI as an open standard, it's hard to see where your trade secret
interests, for example, lie.

Likewise, a free software effort such as Apache has a definite
interest in *not* incorporating any software in which someone else is
going out of their way to claim patent rights, as there is effectively
no one to pay the royalties (and, indeed, if a patent were to issue,
you wouldn't *have* to license it to us, or to any particular party,
at any price).  So those too are problematic.

If your intention is to distribute this on the same terms as tcl,
it probably would be better for everyone if you were just to copy
their legalese verbatim.
