Apache fails to start with restart command

Sometimes (about 1 in 50) when I restart Apache 2.0.47 (this also happened 
with 2.0.46) on RedHat 9.0, it fails to restart. Here is an exmaple of what is 
reported (Note when I run restart again it work fine). It appears that it is 
trying to start before the previous instance has exited??

[root@inetaus2 php-4.3.3]# /etc/init.d/httpd restart
Stopping httpd: [ OK  ]
Starting httpd: [Fri Sep 12 09:13:54 2003] [warn] module php4_module is 
already loaded, skipping
(98)Address already in use: make_sock: could not bind to address 0.0.0.0:443
no listening sockets available, shutting down
Unable to open logs
[ FAILED ]

[root@inetaus2 php-4.3.3]# /etc/init.d/httpd restart
Stopping httpd: [ FAILED ]
Starting httpd: [Fri Sep 12 09:14:00 2003] [ OK  ]

This is quite problematic for me ask my server gets frequently restarted by a 
script when directory permissions are updated.
