Here is a "hack" which fixes the problem on Mac OS X (likely FreeBSD as well).

-           if (ap_os_kill(p->pid, SIGTERM) == -1) {
+           if ( (ap_os_kill(p->pid, SIGTERM) == -1) && (errno == ESRCH) ) {
+               // in case ESRCH means "zombie".
+                waitpid(p->pid, (int *) 0, 0);
