I've tested the small test attached on several Harmony revisions.

This bug was not reproduced on r498001 (end of Jan'2007) build in 500 runs.

On r543133 (end of May'2007) build the bug is reproducible, although more rarely then now
(1 time in 100-300 runs instead of 1 in 20-30 runs).
The same low frequency is for r571484 (end of Aug'2007).
Looks like this bug is not actually a regression since M3.

Anyway, I'm looking for commit which made this bug more visible.
