Depends, some Java EE specifications are open and available under Apache
licence for example.
Java EE by itself is not by the way.
Bean Validation for example has been one of the first.

For the public and open sourced once, of course you can access them without
restrictions.
For private once, like Java EE, you must pay to get them and use them.

As an apache committer, you can access under certain conditions (CLA + NDA)
some of the private TCKs (Oracle provided to Apache for a couple of
projects).
