I didn't say if ApacheDS folks can take the source code verbatim.  I  
asked them if ApacheDS can borrow and adapt some of the techniques  
from OpenDS camps, e.g: performance optimization techniques
 From what I understand CDDL has a patent protection. Thus, it will  
disallow anybody to even adapt the patented techniques.
