I believe a good solution is to have these types of tests run
conditionally based on a system property.  The system property would
only be defined with the automated builds.  Then we will see these
tests fail while developing but the automated build does not report
troubles.  This is what I meant by putting the tests "on probation". 
Once the test succeeds the automated build check should be removed. 
Here is some sample code for it...

if (System.getProperty("AUTO_BUILD").equals "true") {
  return;
}

/* unit test code */
