The wording on these disclaimers varies. I wanted to make sure that everyone subscribed to the derby-user list understands that not only are the Derby mail lists publicly archived in the ASF archives, they also get archived many other places as well. The Derby mail lists page [1] provides links to the Apache (mod_mbox) archives as well as to gmane and nabble. The Derby lists also get archived at mail-archive.com [2] -- and I don't know how many other places. So, understand that posts are publicly archived.
