Do you have a reproducible case that can illustrate this issue?
If so, please file a Jira entry.   Please include not only the DDL but 
how to insert the data and how much is needed to see a difference.

Also, one more question,  did you try this on 10.2 or 10.1?

The derby development community is  always looking for ways to improve 
the optimizer.  If you file a case it might get fixed.  Even though you 
have a workaround, it certainly will save another user some time if you 
file the issue and you may have some other query later that will benefit 
that you don't want to rewrite.
