raising this to blocker as it seems a regression in 10.10, causes nightly regression tests
to fail, 
and unclear what other user level errors may result.  It has reproduced in both ibm15 and
jdk15 on
windows.  So far have stress tested (run the test 100 times) on 10.9 ibm15 windows and not
seen
the problem.  Also did not repro in trunk jdk16.  

If it is a jvm bug would like to understand what derby change is stressing it, and see if
at the very least
we can work around the bug in the 1.5 jvms.
