It would be great to have picked the mind of the author of the comment and code but it appeared
this was this way since the beginning.  I don't think it would hurt to do what you suggest
but just to let you know, this code is not in production being exercised extensively (private
build with this in it as I had a need to fix the problem now) with no issues found.  Just
some empirical testing results.
