I am leaning more towards NOT backporting the changes to 10.8. I realize that in our regression
tests, we have run into this intermittent NPE in stress test for quite a few releases now
but we have not heard of this specific NPE from a user as of yet. 

The Derby code we are planning to change is traversed heavily and since the suggested code
change would not have gone through enough testing, I am hesitant about having it in 10.8 release.
In future, if we do come across users who run into this problem, it will be easy to track
this jira down since the NPE stack trace is clear about where things are going wrong. At that
point, we can consider backporting these changes as needed. Just my 2cents.
