This was in the nightkly IBM run.  The vm used was:
java version "1.6.0"
Java(TM) SE Runtime Environment (build pxi3260sr9fp1-20110208_03(SR9 FP1))

I couldn't find a Jira with a prior report and don't think there was a recent vm update. 
I am guessing there is some very small window where this can happen.
