As far as I can tell, base64.js is used in the old JavaScript test library only. CouchDB 2.0 will remove futon entirely and replace it with Fauxton, which does not include this code - JS tests are run from the command line and I don't believe require base64.js any longer. The license matches no known open source license, and though the authors intent is clear to open source it to some extent, the question is with what restrictions.
