It's perfectly good code, they just didn't bother to update it for the later SDKs, because...
not important to them.
The only way to see if this passes app review is to submit for app review. I wouldn't stir
the hornet's nest by filing a radar -- lots of other apps use local webservers. GoodReader
for example, and other apps that allow people to download the documents from the apps by sending
ppl to a local url.
