The expression is not necessarily correct actually, but that depends on
context and content..

:-)

For instance:

<xsl:copy>
  <newelem />
  <xsl:apply-templates select="@*" />
</xsl:copy>

is not valid, but is likely to cause only errors when the current
element has attributes..
