Just one problem is that this nows adds:
<?xml version="1.0" encoding="UTF-8"?>
at the top - any way to avoid this?

You can configure this in your XHTML serializer declaration:

      src="org.apache.cocoon.serialization.XMLSerializer"

      <doctype-public>-//W3C//DTD XHTML 1.0
