Subject Undesired PI!

Hi All,
I'm using cocoon 1.8.2 with Tomcat 3.2.1 and Apache 1.3.12 on a Linux
Red Hat machine.
I my stylesheet I use the tag:
<xsl:text disable-output-escaping="yes">
 &amp;
[Javascript code]
</xsl:text>
But I found in the output the pi:
<?xslt-next-is-raw formatter-to-dom?>
&
[Javascript code]

So, what can I do to avoid this behaviour?
My Javascript don't work if there is this tag internally to the <script>
tag!
If I try to parse the same document witt the same stylesheet on the
command Line
with Xalan alone and all works well without this pi (<?xslt-next-is-raw
...?>).
