It almost certainly doesn't need to be at the top though.

Just had an idea. Try rebuilding cocoon with xml.jar in front of xerces.jar 
in the CLASSPATH (you'll have to edit build.bat or build.sh) - and tell me 
if it works - if so, I'll add it to the FAQ.
