Hi,

Looks OK.
What version of Cocoon are you using?

basename:
/home/alejandror/tomcat3.1/webapps/ROOT/societe/portal/ui/include.xml
Processing element: [x: null]
Name: x
URI:
Processing element: [include: null]
Name: include
URI:

include.xml:

<?xml version="1.0"?>
<?cocoon-process type="xinclude"?>

<x xmlns:xinclude=" http://www.w3.org/1999/XML/xinclude
<http://www.w3.org/1999/XML/xinclude> ">
 <include xinclude:parse="xml" xinclude:href="disclaimer.xml"/>
</x>

what am I doing wrong ?

Try:

<?xml version="1.0"?>
<?cocoon-process type="xinclude"?>

<x xmlns:xinclude=" http://www.w3.org/1999/XML/xinclude
<http://www.w3.org/1999/XML/xinclude> ">
 <include xinclude:parse="xml" xinclude:href="test.xml"/>
</x>
