Trial 1 is a known restriction of XSP.
Trial 2 is a duplicate of bug #15841: the xsp:attribute elements are collected
first.

For your case the following might work:

<dum2>
<xsp:logic>
String dummy = "aaa";
String s = (String)(request.getParameter("test"));
<xsp:attribute name="key"><xsp:expr>s</xsp:expr></xsp:attribute>
</xsp:logic>
</dum2>
