I found this issue in the xinclude docs:

"Issue (XInclude-31-which-namespace): The authors suggest that the xml: namespace should be
the namespace of the include element.
The use of the xml: namespace allows all xml documents to reference the inclusion mechanism
without requiring additional namespace
declarations to support inclusion. As inclusion is useful to most or all xml vocabularies,
we suggest that it is reasonable to add
to the xml: namespace."

Since it is a draft, are we ignoring the issues right
now?
