In Spec 1.1 this has been clarified:

2.1.13.5.1 Checkout

Therefore, until it is checked in (using the checkIn service), the PWC MUST NOT be considered
the latest or latest major version in the version series. That is, the values of the cmis:isLatestVersion
and cmis:isLatestMajorVersion properties MUST be FALSE.
