That worked thanks.  I aggregated the two labeled filesets into one <path>.

  <path>
   <fileset refid="fset.foobar.label.part.one"/>
  </path>
  <path>
   <fileset refid="fset.foobar.label.part.two"/>
  </path>
</path>
